School Age

School age is the period of a child's life from either the earliest admission age to a school district's kindergarten program or to the district's earliest admission age for beginners until the age of twenty-one years or graduation from high school, whichever occurs first. School age can begin before the age of six years because the school board can set the age of earliest admission before the age of six years, but all persons residing in Pennsylvania who are between the ages of six and twenty-one are entitled to a "free and full education" in the public schools. 22 Pa Code § 12.1 Of course, under IDEA the upper age limit could be extended.

School age creates a property right for students in Pennsylvania, which would extend from the age of earliest admission established by the school board, but not later than six years, until the age of twenty-one years or graduation from high school, whichever occurs first. 22 Pa Code § 11.12
