Informal hearing

A student is entitled to an informal hearing in any case that involves a possible suspension. When the suspension exceeds three school days, the student and parent must be given the opportunity for an informal hearing in accordance with 22 PA Code § 12.6(b)(1)(iv). The purpose of the informal hearing is to allow the student to meet with the appropriate school official to explain the nature of the event for which the suspension is being imposed. The intent of the hearing is "….to encourage the student's parents or guardian to meet with the principal to discuss ways by which future offenses can be avoided." 22 PA Code § 12.8(c)(1) The due process requirements of the informal hearing are presented in 22 PA Code § 12.8(c)(2).

When an in-school suspension exceeds ten consecutive school days "….an informal hearing with the principal shall be offered to the student and the student's parent or guardian prior to the 11th school day in accordance with the procedures in § 12.8 (relating to hearings)." 22 PA Code §12.7(c)
