Regulations of the Pennsylvania State Board of Education


The Pennsylvania State Board of Education promulgates regulations through a regulatory process, which includes the publication of proposed rules in the Pennsylvania Bulletin. After comments and revision, the State Board gives approval to the regulations but the Independent Regulatory Review Commission, the House and Senate education committees, and the office of the Attorney General of Pennsylvania must still approve the regulations. When the regulations have been given final approval they are published in the Pennsylvania Code in volume 22. These regulations are binding on the Pennsylvania Department of Education and the school districts of the Commonwealth. See 24 PS § 26-2606-B and 22 PA Code § 1.3 .

Each regulation is placed in the appropriate chapter of volume 22 and can be located by using a citation, which includes the section of the chapter in which the regulation is located. For example, regulations concerning students are placed in Chapter 12. The section of Chapter 12 dealing with "Corporal punishment" is § 12.5. A citation to the section of the State Board regulations dealing with corporal punishment is: 22 Pa. Code § 12.5 (i.e. volume 22 of the Pennsylvania Code; Section 12.5 of Chapter 12 of that volume).
