Category C Data

Category C data includes unverified but potentially useful information, which is not clearly needed beyond the present. This data is described in § 2.3 of Exhibit A of Chapter 12 of 22 Pa Code. School officials should review this data at least once a year and destroy the data when no longer useful. School officials may also transfer these data to Category "B" data. Two conditions must be met in order to transfer the data: (1) the school must demonstrate the continuing usefulness of the information, and (2) the validity of the data must be verified and the parents must be notified and the nature of the information must be explained to them. A quasi-judicial review panel should be created to determine the validity of Category "C" data and to consider parental challenges concerning such data when there is a proposed transfer of the data to Category "B". This panel should be composed of qualified professional personnel. There should be an annual review of all data retained in Category "C" and parents should have an opportunity to challenge the decision to maintain this data. The only condition under which a school should release information in this category is in compliance with judicial orders, etc, in which case the parents and/or students should be notified of the orders and the school's compliance.
