Section 1123 of the Public School Code of 1949, as amended, requires the Department of Education to prepare a rating card to be used to rate employees through a system that gives due consideration to personality, preparation, technique and pupil reaction.
The PDE 5501 form or an approved alternative form must be used to determine whether a professional employee shall be dismissed for incompetency, or in rating the services of a temporary professional employee for the purpose of granting tenure. Although the standards for using the PDE-5501 make specific reference to incorporating ratings into the suspension process pursuant to Section 1125, Section 1125 has been repealed and replaced by Section 1125.1 which makes no mention of using a rating for purposes of suspension determination. Consequently, this portion of the standards for using PDE-5501 should be disregarded.
Because Act 16 of 1996 amended Section 1108(b)(2) of the Public School Code of 1949, the standards on the reverse of PDE-5501 should change the phrase "during the last four (4) months of the second year" to "during the last four (4) months of the third year" unless the district initially employed the individual as a temporary professional employee prior to June 30, 1996. Because PDE-5501 constitutes 22 Pa. Code Section 351.21, format revision of the published form awaits revision of Chapter 351.
